CJ’s removal: Sophia Akuffo’s comments amount to breach of oath of secrecy as Council of State member – Ansa-Asare

Former Director of Ghana School of Law, Kwaku Ansa-Asare has said former Chief Justice, Sophia Akuffo has breached the oath of secrecy as a member of the Council of State for making comments against the removal of Gertrude Torkornoo as Chief Justice.

In an interview with TV3’s Joseph Ackah-Blay, September 3, 2025, Sophia Akuffo averred that Torkornoo was not given a fair trial. Among other things, the member of the Council of State noted that the allegations against Madam Torkornoo were not strong enough to warrant her removal from office.

Sophia Akuffo further said that the removal of Madam Gertrude Torkornoo as Chief Justice has weakened the judiciary, describing her hearing as a “treason trial.”

“My honest and candid view is that this has so weakened the institution of the Judiciary.

“She did not get a fair trial. Even though it is not a trial strictly speaking, it was handled as though it were a treason trial,” Sophia Akuffo stated.

However, reacting to these comment by Sophia Akuffo, Kwaku Ansa-Asare explained that the former Chief Justice has breached the trust reposed in her as a member of the Council of State.

He further noted that by subscribing to the oath of secrecy while being sworn-in, Sophia Akuffo ought to have remained silent on the matter, describing the interview as “inappropriate.”

“All I can say is that our eminent and distinguished former Chief Justice of the Republic of Ghana has nodded a little. The public has reposed confidence in her, she subscribed to the oath of a member of Council of State and oath of secrecy so her comment and the whole interview is inappropriate.

“…seeks to realize that she cannot say anything and some of the things she said is just indirectly to her knowledge of what actually transpired at the Council of State and her appearance at the Committee sittings and once she has subscribed to certain oath, she must always bear in mind that the Oath is a secret duty which must not be broken,” Ansa-Asare stressed in an interview on TV3’s NewsCentral, September 3, 2025.

“What she has done is in clear breach of the trust the good people of Ghana have reposed in her,” he remarked.

The private legal practitioner believes that the actions of Sophia Akuffo raises issues of governance, confidence and trust in persons who are at the helm of affairs and who are the limelight of the nation and “should speak as one of the consciences of the Republic of Ghana.”

“My good advise to my distinguished former Chief Justice is that in such matters, she should remain silent in view of the oath that she has subscribed to,” he encouraged.
