Justice Kulendi, Jakpa dragged to CID over alleged interference in Ato Forson trial

AA Ghanaian citizen, Daniel Marfo Ofori-Atta, has petitioned the Criminal Investigations Department (CID) to investigate Supreme Court Justice Yonny Kulendi and National Security Director of Operations Richard Jakpa for allegedly conspiring to obstruct justice in the discontinued ambulance procurement trial that involved former Majority Leader and now Finance Minister, Dr Cassiel Ato Forson.

In a petition dated September 29, 2025, Mr. Ofori-Atta accused the two of engaging in acts that undermined the integrity of the judicial process during the trial of Republic v. Cassiel Ato Forson & 2 Others. Mr. Jakpa, who was the third accused in the case, is a cousin of Justice Kulandai.

According to the petition, Mr. Jakpa allegedly solicited the assistance of Justice Kulendi from the onset of the trial in January 2023, with the aim of securing leniency from the then Attorney-General, Godfred Yeboah Dame. Mr. Ofori-Atta claimed that Justice Kulendi personally visited Mr. Dame’s office to request the release of his cousin, despite Jakpa not meeting his bail conditions.

The petitioner further alleged that under cross-examination in June 2024, Mr. Jakpa admitted obtaining Mr. Dame’s phone number from Justice Kulendi, after which he sent 68 WhatsApp messages to the Attorney-General, who responded only twice. The messages were tendered as evidence in court.

Mr. Ofori-Atta also cited records of proceedings indicating that Justice Kulendi hosted multiple meetings at his residence, where Mr. Dame and Mr. Jakpa were allegedly present, in attempts to influence the Attorney-General to drop the prosecution or secure Jakpa’s discharge at the submission-of-no-case stage.

“These acts show a calculated effort by the learned Justice of the Supreme Court together with his cousin to interfere in the prosecution of the criminal case filed against Richard Jakpa by the Republic of Ghana. This is not only dishonourable but also borders on the commission of crimes,” the petition stated.

The petitioner attached copies of WhatsApp messages between Mr. Jakpa and Mr. Dame, as well as certified records of proceedings from the trial, to support his request for an investigation.

He urged the CID to unravel the alleged conspiracy and take prosecutorial action if necessary.

“I am available and willing to assist you with any documents, including relevant exhibits and the record of proceedings,” Mr. Ofori-Atta assured.

The ambulance trial, which began in 2023, involved allegations of financial loss to the state in the procurement of 200 ambulances under Mahama’s first administration.
