The Deputy Attorney-General, Dr. Justice Srem Sai, has stated that the Office of the Special Prosecutor (OSP) does not have independent authority to initiate prosecutions without the approval of the Attorney-General.
Speaking on Point of View on Channel One TV, Dr. Srem Sai stressed that the relevant Act governing the OSP does not authorise the office to prosecute cases on its own.
“I don’t believe that the Act authorizes the OSP,” he said, adding that the Special Prosecutor must obtain explicit approval from the Attorney-General before proceeding with any prosecution.
The comments come amid ongoing discussions about the powers and operational independence of the Office of the Special Prosecutor in Ghana’s anti-corruption architecture.
Dr. Srem Sai’s position highlights a potential legal clarification needed on the relationship between the OSP and the Attorney-General’s Department.
