It’s a complete misadventure and shouldn’t be permitted – Tameklo on former CJ’s suit for reversal of her dismissal

Private legal practitioner and Chief Executive of the National Petroleum Authority, Godwin Edudzi Tameklo, says the High Court should not entertain the latest judicial review application by the former Chief Justice, Gertrude Torkornoo.

Mrs Torkornoo is praying the court to reverse her dismissal as well as prohibit the appointment of a new Chief Justice.

Mr Tameklo argued that permitting such a process would create what he called “constitutional chaos”.

Speaking on the KeyPoints with Alfred Ocansey on October 18, Tameklo explained that in this particular case the President had already accepted a recommendation from the investigative committee and, based on that, removed the officer by issuing a warrant.

He added that a replacement has already been nominated and is awaiting parliamentary vetting.

Intervening at the High Court stage, he said, would disrupt an ongoing constitutional process.

“A High Court intervention has the tendency to bring chaos. The Constitution should not be manipulated in any way that results in recklessness or disorder,” he stressed.

According to him, the judicial review application “stands no chance”, describing it as weak and fundamentally flawed.

“It is a complete misadventure and should not be permitted,” he told the court, adding that governance is “serious business” and not a space for legal experiments.

Tameklo also pointed out that proceedings under Article 146 are sui generis, meaning unique in nature and were designed by the framers to bring closure to such matters in the public interest.

He warned that if the High Court allows the review application, matters meant to be heard in camera under Article 146 would now be debated openly in a regular courtroom, which he believes undermines the constitutional framework.

“The invitation ought to be declined. These proceedings are unique for a reason to maintain order, not chaos,” he argued.

On October 17, Mrs Gertrude Torkornoo filed a High Court suit seeking to halt the vetting and appointment of Justice Baffoe-Bonnie as Chief Justice and to nullify all actions by the committee whose findings led to her September 1, 2025 removal by President John Mahama.
