Keep evidence of helping your wife or husband to acquire property – Lawyer explains

Lawyer Ernestina Obboh Botchwey ( Lawyer Tina) has advised partners in romantic relationships and marriages to endeavour to keep evidence of their contributions to the relationships, especially concerning financial contributions for the acquisition of property.

She explained that when things go south and the parties seek to recover their investments during the good times, it is evidence that will enable them to succeed before a court of law, stressing that without evidence, it may be difficult for the courts to help the aggrieved party.

Lawyer Tina, who has considerable practice in family law, advised people to be mindful to keep traces of their effort in relationships, such as sending money through bank transfers, mobile money transfers, instead of handing over physical cash.

“If you’re acquiring property with someone like your boyfriend, husband, or wife, evidence is important. Evidence is what you’ll get, 10% or 20%. It is evidence that will allow you to demonstrate that you contributed. It is evidence that when the love ends, you can use to get a share of the things you got together,” she explained in a video posted on her YouTube Channel, Ghana Law and More.

“It is preferable that you send money through your bank account and add a description to it. For example, this money is for the building. Don’t withdraw money from the ATM[ and hand over physical cash], use bank transfers, mobile money transfers and add some details,” she clarified.

Using the legal case of Ernestina Beateng v Phyllis Serwah and Others, she revealed how the Supreme Court, even though it pronounced that the plaintiff had no valid marriage with her husband, she was nevertheless entitled to a share of the property they jointly acquired because she was able to show evidence of her contribution in the acquisition of the property during their illegal marriage.
